A hosting company stole my domain name without do process?

I hosted with ait hosting service and when I decided to move my domains to another hosting service they decided to change the registration of the master domain to their company. How can I fight this e legal action? I contacted ICANN but they do not seem to have much advice.

Quite common for hosting companies to offer free domain with hosting, and they retain ownership of the domain. I doubt domain was ever yours to begin with. Too bad, but unethical is not illegal. You will probably find notice of this in all the fine print you agreed to when opening your hosting account.

Your only hope is if your name was listed as owner at the time of registration and they did an illegal transfer, but I doubt it.

    Hello,

First check whois of the domain on site like:

    http://www.whois.sc

There check if domain admin is in your name.

Domain registrar can help you only if Admin Details are in your name, as per law Domain Admin Contacts are owner of the domain.

If domain admin is in your name, contact respective ICANN registrar and ask them to give you domain control panel ( you must contact them from domain’s Admin Email id)

If Admin whois is not in your name, then if you have any Incoice of your hosting provider in which he charged you for domain, ob behalf of that send a legal notice to your Hosting provider, send a copy to that notice to registrar, so registrar will lock the domain with immediate effect and then file a case in any nearby Cyber Crime branch.

For all people who purchase domains from small hosting companies it is a clear advisory to get ADMIN details of domain in their name, else you cant claim the domain.

ICANN registrars are bounded to give details only to Admin of the domain, they cant give control of domain to other then Admin.

    Regards,

    Vinay
